Garden City, Inc., d/b/a Casino M8trix, and its affiliates (e.g., its parent company, subsidiaries, and other companies owned or controlled by Casino M8trix, or under common ownership or control with Casino M8trix) (collectively, “we,” “our,” “us,” or “Casino M8trix”) is an entertainment destination, providing gaming, dining, event space, and other entertainment related products and services for adults (collectively, “Services”) at our casino property in San Jose, California.
Casino M8trix does not sell your personal information for monetary compensation to third parties. However, as outlined in this Privacy Policy, we collect, use and disclose information about you, both online and offline, in providing our Services and when you use our Services, whether in person at our casino or online through our website(s) (e.g., www.casinom8trix.com), mobile application(s), social media pages, and other electronic communications (each a “Site”). There may be additional notices of our offline privacy practices that we may provide to you at or before the time we collect your personal information. Please read any such notices so you can understand how they apply to you.
By visiting or otherwise using our Sites or our Services, you are consenting to our collection and handling of your information as set forth in this Privacy Policy. If you do not agree or wish to consent, please discontinue use of our Site(s), and do not use or participate in our Services.

1. Information We Collect
In the 12-months preceding the Last Updated and Effective Date of this Privacy Policy, we have, and continue, to collect personal information from you and from various other sources in a variety of ways, as follows.
- Identifiers, including real name, alias, postal address, telephone number, date of birth, unique personal identifier, online identifier, internet protocol (IP) address, email address, account name, social security number, driver’s license number, passport number or other similar identifiers. For example, when you visit, use, or access any of our Sites or Services (e.g., to subscribe to Club 8 Rewards, use our Contact Us page, make reservations or inquire into any of our Services), you provide us with personal information such as your name, telephone number, and email address. When you park at our casino, we may collect information about your vehicle, including an image of your vehicle, its make, model and license plate number, and the date and time you were on our property (“Vehicle Information”), for safety, security, fraud prevention and other purposes.
- Personal information described in Cal. Civ. Code 1798.80 (e) including, but not limited to, name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information. For example, when you make a purchase, visit, use or access our Site or Services, you may provide us with your credit or debit card or other financial account information, your driver’s license or state-issued identification card or passport. For safety, security, regulatory and other purposes, we use video and other surveillance systems to monitor the activities at our casino property, which capture visitors’ physical characteristics and other such personal information (“Video Surveillance Information”)
- Characteristics of protected classifications including race, color, national origin, ethnic origin, sex, sexual orientation, gender, gender identity, gender expression, age, disability status, military and veteran status, and other protected classifications under California or federal law. For example, when you apply for a job with us, we collect this type of information for equal opportunity or affirmative action programs, as required or permitted by law. Protected classification characteristics may also be collected when you visit, access or use a Site or our Services, including by video surveillance for safety, security, fraud prevention and other purposes.
- Commercial information including records of personal property, products or services purchased, obtained or considered, or other purchasing or consuming histories or tendencies; gaming-related information, entertainment, travel, dining, and lodging. When you visit, use or access our Site or Services, we may collect information about your activities including your purchases, reservations and gaming activity, including information required by gaming regulators.
- Biometric information, meaning physiological, biological, or behavioral characteristics including imagery of the iris, retina, fingerprint, face, facial recognition, hand, palm, vein patterns and voice recordings, intended to be used singly or in combination with each other or other identifying data to establish individual identity. For example, we use video and other surveillance systems at our casino property for safety, security, fraud prevention and other purposes, which may incorporate facial recognition technologies.
- Internet or other electronic network activity, including Internet Protocol (IP) address, browsing history, search history, interaction with an internet website, application or advertisement. When you use our visit, use, or access our Site or Services, including Wi-Fi services at our casino, we may collect (directly or through third parties) your IP address, information about the type of device and browser you are using, your interaction with our website, the websites you visit, your precise physical location, etc. Casino M8trix and its third-party service providers may also collect and use “cookies” and similar technologies to improve, enhance and optimize your online experience with our website, to conduct website traffic and other data analytics, and to modify, improve and enhance any of our Sites and Services. When you use integrated social media features associated with or relating to Casio M8trix and its Site or Services, or other social media websites or mobile applications, we may obtain information including your name, online profile, e-mail address, and videos, recordings and images of you (“Social Media Information”). For more information about the cookies we use, please see the section of this Privacy Policy discussing Cookies below.
- Geolocation data, or data derived from a device that is used or intended to be used to locate a consumer within a geographic area.
- Audio, electronic, visual, thermal, olfactory, or similar information, included voicemail messages, phone and/or video interviews, recorded phone calls, etc. When you visit our casino, we use video and other surveillance systems to monitor gaming and other public areas within and around our property for safety, security, fraud prevention and other purposes. When you call us to make reservations or inquire about any of our Services, we receive your voicemail messages, we may obtain information about you and your request, and we may monitor and record such interaction.
- Professional or employment-related information, including information on your resume or curriculum vitae, employment history, education history, certifications, languages, security clearance information, work authorization, past and expected compensation, information of professional and personal references and referral sources, emergency contact information, and other work-related information. When you apply for a job with us, you may provide us with your work history, and we may collect background and other security clearance information as part of the employment application process (“Employment Application Information”).
- Education information that is not publicly available personally identifiable information as defined in the Family Education Rights and Privacy Act (20 U.S.C. Sec. 1232g; 34 C.F.R. Part 99). If you apply for a job with us, you may provide us with your resume and non-public education history.
- Inferences drawn from any other personal information to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes including assessment of aptitudes, abilities and preferences.
- Sensitive personal information including social security, driver’s license, state identification card, or passport number; account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; a consumer’s precise geolocation; a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; contents of a consumer’s mail, email, and text message to recipients other than us; and genetic data. As above, when you make a purchase, visit, use or access a Site or our Services, engage in other transactions or activities with us, or apply for a job, we may collect your financial account, credit or debit card number, your social security number, driver’s or state identification card numbers, precise geolocation, union membership, and other sensitive personal information.
Not Intended for Children: Casino M8trix’s Sites and Services are intended for persons 21 years of age or older. If you are under 21, you are not to access or attempt to access any areas of our Sites or Services that are restricted to persons 21 years of age or older.
Casino M8trix does not intend to, nor do we knowingly collect, use, share, disclose or sell personal information of children under 16 years of age, with or without parent or guardian authorization.
If a parent or guardian of a child under 13 believes that the child has provided us with any personal information, the parent or guardian should contact us by email at Privacy@CasinoM8trix.com, by phone at toll free number (888) 322-9609, or by mail to Casino M8trix, 1887 Matrix Boulevard, San Jose, California 95110, Attention: PRIVACY INQUIRY, and ask to have this personal information deleted from our files.
2. Categories of Sources from Which Information is Collected
In the 12-months preceding the Last Updated and Effective Date of this Privacy Policy, we may have received, and may continue to receive, personal information about you from the following categories of sources:
- Information you provide to us when you visit, access, or use any of our Sites or Services, engage in social media and other online activity associated with or relating to Casino M8trix, or apply for employment, include Employment Application Information, Vehicle Information, purchase and transaction information, sensitive information, Wi-Fi and location information, device and browser information, Video Surveillance Information, and other information described above in Section 1 subsections A, B, C, D, E, H, I, J, and L.
- Information automatically collected through our website, social media platforms and online advertising services include device and browser information, Social Media Information and other information described above in Section 1 subsections F, G and H.
- Information we automatically collect when you use our Wi-Fi Services described above in Section 1 subsection F.
- Information we automatically collect from mobile devices at our casino include Wi-Fi and location information described above in Section 1 subsections F and G.
- Information obtained from other sources, including third-party service providers, contractors and/or business partners, data analytics providers, employment recruiting agencies, your family, friends and former employers, data brokers, such as public databases, credit bureaus, credit reporting service providers, background check service providers, regulators and other government agencies include information described above in all subsections of Section 1.
Third-party data collection, storage, sharing, and other activities are subject to those third parties’ privacy policies and practices. Casino M8trix makes no representations regarding, and is not responsible or liable for, the accuracy or completeness of the information provided by third parties or for those third parties’ policies or practices. We may combine such third-party data with other information we acquire or receive from or about you in order to provide our Services.
3. Our Business or Commercial Purpose for Collecting, Using and Sharing Personal Information
In the 12-months preceding the Last Updated and Effective Date of this Privacy Policy, we may have used, and may continue to use, the categories of personal information as described in Section 1 above, as well as for the following business or commercial purposes:
- To validate your identity and age, as required or permitted by gaming regulations and other lawful business purposes
- To create and update customer profiles
- To recording and access gaming-related activity, as required or permitted by gaming regulations
- To determine your eligibility for receiving offers
- To develop, improve, correct, manage, administer, and otherwise provide Casino M8trix Services
- To complete transactions, fulfill terms or obligations, and otherwise perform Casino M8trix’s Services
- To process, fulfill, and track reservations, purchases, or other transactions such as event space usage and accommodations, gaming activities, food and beverage services, retail, and entertainment
- To customize or personalize your experience while visiting our Sites or using our Services
- Marketing Casino M8trix, our Sites and our Services, including notifying you of special promotions, offers and events, via e-mail, direct mail, social media, telephone, text messages, push notifications and other means.
- To conduct internal research, analytics, and statistical or demographic analysis;
- Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
- To detect security incidents, protect against malware, illegal activity, and/or pursue those responsible for such illegal activity
- Identify and repair errors that impair functionality of our Sites
- To identify, contact and match candidates for job opportunities with Casino M8trix
- To perform background checks
- To meet legal obligations as an employer or potential employer
- For purposes of equal opportunity or affirmative action programs, as required or permitted by law

- To comply with applicable laws and legal requirements, such as court orders, subpoenas, search warrants, and gaming regulations, and to cooperate with regulatory agencies and law enforcement for purposes of national security, public safety, or matters of public importance when we believe that disclosure of information is necessary or appropriate to protect the public interest
- To establish or exercise legal rights including collecting debts, and/or defend against legal claims directed to Casino M8trix, its Customers, and others for whom Casino M8trix has a legal duty to do so.
4. Sharing or Disclosure of Personal Information
Casino M8trix does not sell your personal information for monetary compensation, and it has not sold any personal information for monetary compensation in the preceding 12 months.
In the 12 months preceding the Last Updated and Effective Date of this Privacy Policy, we may have disclosed, and may continue to disclose, certain personal information categorized in Section 1 above to the following categories of third parties for the business purposes described in Section 3 above:

- Third-party service providers and/or business partners: We use vendors, consultants, and other service providers and/or business partners to assist us in providing our Sites and Services, and it may be necessary for us to provide them with access to your personal information, e.g., service providers who provide IT support, who provide background checks, and who provide software solutions as part of or necessary for us to provide our Services.
- In compliance with laws, at your consent or direction, and to protect rights, property and safety: We may preserve and disclose your information if we believe doing so is legally required or appropriate: (i) to comply with applicable laws and regulations, law enforcement or national security requests and legal process, such as a court orders or subpoenas; (ii) in response to your consent or at your direction to disclose the information; (iii) to protect your, our, or another’s rights, property, or safety; or (iv) to enforce our rights, policies and/or contracts.
- Merger, Sale, or Other Asset Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another person or entity, then your information may be shared as part of such a transaction as permitted by law and/or contract.
- With your consent: We may share or disclose your personal information for other purposes per your request or with your consent.
5. California Privacy Rights
If you are a resident of California, you have rights with respect to your personal information pursuant to the California Consumer Privacy Act of 2018, as amended by the California Privacy Right Act, Cal. Civ. Code §§ 1798.100 et seq., and implementing regulations, as may be amended from time to time (collectively, the “CCPA”), as follows:

- Right to be informed about your personal information: You have the right to be informed of the categories of personal information collected about you, the categories of sources from which your personal information was collected, the business or commercial purposes for which your information is collected, used, sold, shared or disclosed, and the categories of third parties to whom we have shared or disclosed your personal information.
- Right to request your personal information: You have the right to request that we disclose to you the specific pieces of personal information we have about you during the 12 months before your request, and we are required to fulfill such a request no more than two times within a 12-month period.
- Right to correct inaccurate personal information: If the personal information we have about you is inaccurate, subject to certain exceptions, you have the right to request that we correct that inaccurate personal information, taking into account the nature of the personal information and the purpose of the processing of that personal information. We will use commercially reasonable efforts to correct inaccurate personal information.
- Right to request deletion of your personal information: You have the right to request that your personal information be deleted, subject to certain exceptions. For example, your request to delete is subject to the need to complete transactions for which the personal information was collected and to comply with legal obligations.
- Right to opt-out of the sale of personal information: Casino M8trix does not sell personal information for monetary exchange to third parties. But you have the right to opt-out of having your personal information sold to or shared with third parties.
- The use of certain cookies placed by third parties on our Site(s) may constitute a sale or sharing of personal information under California law. In addition to submitting your request or calling us, as described below in “How To Submit A Request,” to fully exercise your California privacy right to opt out, you may clear cookies and turn off cookies by using your web browser settings (see section discussing Cookies below). The cookie preference tool is device and browser specific. If you delete or clear cookies or change devices or browsers, you will need to reset your cookie preferences using your web browser settings. Please note that even if you opt-out of the sale or sharing of your personal information, we may still disclose your personal information to third-party service providers and/or business partners, gaming regulators and other government entities for business or commercial purposes consistent with the California Privacy Rights, or as legally required of us.
- With respect to cookies and similar technologies, during the 12 months preceding the Last Updated and Effective Date of this Privacy Policy, we may have sold or shared (as may be defined by California law) three categories of personal information, specifically, Identifiers, Internet and other electronic network activity, and Inferences, for online advertising purposes and to provide third-party social network platform functionality on our website.
- Right not to be discriminated against: In exercising any of the foregoing consumer privacy rights, you have the right not to be discriminated against. Casino M8trix will not deny you Services or provide you a different level of Services for exercising your rights, unless the difference is reasonably related to the value of your information.

You may also designate an Authorized Agent to make a request on your behalf. You may make such a designation by providing the Authorized Agent with your written and signed permission to act on your behalf and by directly confirming with us that you have provided the authorized agent permission to submit the request. As permitted by law, we may require you to verify your identity in response to a request even if you choose to use an Authorized Agent. The Authorized Agent will also need to verify its own identity directly with us. Thus, we will need to contact you as requests through an Authorized Agent require additional identifying information and a signed declaration under penalty of perjury, attesting to your and your Authorized Agent’s identities.
After you or your Authorized Agent submit a request, we require a high degree of certainty that we have verified that the requester is, in fact, the California consumer whose personal information is the subject of the request. We will endeavor to do so using the personal information that we, or one of our third-party service providers and/or business partners, have about the consumer. We may need to obtain additional personal information from you or from other third-party sources to verify the requester’s or Authorized Agent’s identity, in which case, such additional personal information will be used solely for verification purposes. If we are unable to verify your identity, we reserve the right to deny your requests.
- California “Shine the Light” Law: California’s “Shine the Light” law (California Civil Code section 1798.83) gives California residents the right to ask, once a year, (1) what personal information was disclosed to third parties for those third parties’ direct marketing purposes in the prior calendar year; and (2) the identities of the companies with whom the information was shared. The terms “customers” and “personal information” have the meaning given by the Shine the Light (California Civil Code Sec 1798.83).
We do not share personal information, as defined in California Code Civil Section 1798.83, with third parties for their direct marketing purposes absent your consent. If you are a California resident, you may request information about our compliance with California’s Shine the Light law by sending us a written request to Privacy@CasinoM8trix.com or mailing us a letter to: Casino M8trix, 1887 Matrix Boulevard, San Jose, California 95110, (Attention: “Shine the Light” Inquiry). Any such written request must include “California Shine the Light Law Request” in the first line of the description and include your name, street address, city, state, and zip code. We are only required to respond to one Shine the Light law request per customer per year, and we are not required to respond to requests made by means other than through this email address and mailing address.
Further note that “Shine the Light” rights and the California Privacy Rights under subsections A through G in this Section 5 are provided under different statutes and must be exercised separately.

How to Control, Disable or Remove Cookies
At any time, you can use your web browser’s method of blocking or removing cookies from all websites you visit, including our Site. For example, if you use Chrome, launch the browser, open Settings, and then select Privacy and Security. You can then select Clear browsing data, which will allow you to clear cookies and other website data, your browsing history, your download history, and more. You can also select or Site settings to control what information websites can collect, use and show (location, camera, pop-ups, and more).

Do Not Track
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. 7. Security of Information
We maintain reasonable safeguards to protect our systems from unauthorized access or use and to protect information from accidental or unauthorized access, use, disclosure, modification, loss or destruction. We require third parties providing services on our behalf to do the same. However, no security system is impenetrable.
